Terms of Service

1. Accounts

You must provide accurate information when creating an account and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account and dealership workspace. Notify us promptly of any unauthorized use.

2. The service

LotShot provides AI-assisted photo editing and related tools for vehicle listings. We may add, change, or remove features over time. We strive for high availability but do not guarantee the service will be uninterrupted or error-free.

3. Credits, plans & billing

• Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. Credit packs are one-time purchases billed in advance.
• AI actions consume credits. Credits are deducted when a job is submitted. If a job fails, the credits for that job are automatically returned to your balance.
• You can cancel a subscription at any time; access continues until the end of the current billing period, after which the subscription will not renew.
• Prices may change with notice; changes apply to subsequent billing periods.

4. No refunds

All payments are final. Subscription fees, renewal fees, and one-time credit pack purchases are non-refundable, and we do not provide refunds or credits for partial billing periods, unused credits, downgrades, or credits consumed by successfully completed jobs.

The service delivers digital content and AI processing on demand. By submitting a job and consuming credits, you request that performance begin immediately and acknowledge that, to the extent permitted by law, you thereby waive any statutory right of withdrawal or "cooling-off" period once performance has started.

This section does not limit any non-waivable rights you may have under mandatory consumer protection law (including, where applicable, the laws of the Netherlands and the European Union). Where such law requires a refund, we will honor it to the extent legally required.

5. Your content

You retain ownership of the photos and information you upload ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to operate and provide the service to you. You represent that you have the rights to upload Your Content and that it does not infringe any third party's rights.

6. Acceptable use

You agree not to:

• Upload content that is unlawful, infringing, or that you lack rights to use.
• Misrepresent a vehicle's condition or create deceptive imagery intended to mislead buyers.
• Reverse engineer, scrape, or abuse the service, or attempt to bypass usage limits.
• Interfere with the security or integrity of the service or other users' data.

You are responsible for ensuring your listings comply with applicable advertising and consumer-protection laws.

7. Intellectual property

The service, including its software, design, and trademarks, is owned by LotShot, Inc.and protected by law. These Terms do not grant you any rights to our intellectual property except the limited right to use the service.

8. Termination

You may stop using the service at any time. We may suspend or terminate access if you violate these Terms or to protect the service. Upon termination, your right to use the service ends; certain provisions survive, including ownership, disclaimers, and limitations of liability.

9. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated output may contain inaccuracies; you are responsible for reviewing results before publishing.

10. Limitation of liability

To the maximum extent permitted by law, LotShot, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months preceding the claim.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the product or by email. Continued use after an update constitutes acceptance of the revised Terms.
